These Terms of Service govern your access to and use of SwiftEstimate, a mobile estimating and proposal application operated at getswiftestimate.com. By creating an account you agree to these terms.
1. The service
SwiftEstimate provides tools for independent contractors to build price books, generate estimates, share them with their customers, collect electronic signatures, and accept payments. We provide the software; you remain solely responsible for the accuracy of the pricing, scope, and workmanship described in every estimate you send.
2. Accounts and eligibility
You must be at least 18 years old and legally able to enter contracts. You are responsible for safeguarding your login credentials and for all activity under your account, including activity by crew members you invite. Notify us promptly at support@getswiftestimate.com if you suspect unauthorized access.
3. Subscriptions and billing
Paid plans renew automatically each billing period until canceled. Prices are shown in the app before purchase and are billed through Stripe. Add-ons (such as SMS credits) and one-time services (such as price book setup) are billed as described at checkout. You authorize us to charge your payment method for all applicable fees and taxes. Cancellation and refund handling is described in our Refund Policy.
4. Your content and customer data
You retain ownership of your business information, price book, estimates, logos, and customer records. You grant us a limited license to host, process, and transmit that content solely to operate the service. You represent that you have the right to collect and share any customer information you enter, including phone numbers used for text messaging.
5. Text messaging
Automated follow-up, review request, and notification messages are sent on your behalf. You are responsible for obtaining any consent required by applicable law (including the TCPA and carrier A2P requirements) before adding a customer's mobile number. Recipients may reply STOP to opt out at any time.
6. Payments between you and your customers
Payments, deposits, and financing offers collected through SwiftEstimate are processed by Stripe and, where applicable, third-party lenders. SwiftEstimate is not a party to the contract between you and your customer, is not a lender, and does not guarantee payment, performance, or job outcomes.
7. Acceptable use
Do not use SwiftEstimate to send unlawful, deceptive, or harassing communications; to misrepresent pricing or licensing; to infringe intellectual property; or to attempt to access, disrupt, reverse engineer, or resell the service. We may suspend accounts that violate these rules.
8. Availability and disclaimers
The service is provided "as is" and "as available." We do not warrant that it will be uninterrupted or error free, and offline features depend on your device and connection. You are responsible for reviewing every document before sending it to a customer.
9. Limitation of liability
To the maximum extent permitted by law, SwiftEstimate's total liability for any claim relating to the service is limited to the amounts you paid us in the twelve months before the claim. We are not liable for lost profits, lost jobs, or indirect or consequential damages.
10. Termination
You may cancel at any time from Settings. We may suspend or terminate accounts for non-payment or violation of these terms. After termination you may request an export of your estimate data for 30 days.
11. Changes and contact
We may update these terms; material changes will be announced in the app or by email. Continued use after the effective date constitutes acceptance. Questions: support@getswiftestimate.com.
